Terms & Conditions
This Agreement (“Agreement”) is entered between 10QUEST, having its registered office at NCQUEST ONLINE SERVICES PRIVATE LIMITED: 536/40B Chak Dondi, Naini, Allahabad, Uttar Pradesh India, 211008, through its website 10quest.in and ‘You’ as the User on the website. The terms such as ‘Company’, ‘Platform’, and ‘10QUEST’ shall be used in reference to the Platform, and the terms such as ‘You’ and ‘User’ shall be used in reference to the User of the website.
NOW, THEREFORE, IN CONSIDERATION OF THE PROMISES AND MUTUAL COVENANTS SET FORTH HEREIN, THE PARTIES HERETO, INTENDING TO BE LEGALLY BOUND, HEREBY AGREE AS FOLLOWS:
1. SCOPE OF SERVICES:
The Platform provides the following Services (the “Services”):
1.1 An online mobile application-based platform where users can compete in various time-limited quiz contests.
1.2 Users can earn money by testing their knowledge and educational skills.
1.3 Contest details will be provided to users who have registered on the application, and they can also be viewed on the FAQ (clicking on FAQ will take the user to the FAQ page) page of the website. Users can view the rules, duration, levels, and rewards before registering for the quiz contests.
2. DURATION:
2.1 Each quiz contest held on the online platform will last no more than 10 minutes. The quiz will consist of ten questions of varying difficulty levels, which the user must answer correctly within a certain amount of time. The length of the program may change in the future, and this will be communicated in future updates, as will the terms and conditions.
3. PAYMENT TERMS:
3.1 Following the conclusion of the quiz contest, the program will automatically retrieve the results, allowing users to check their standing based on their performance. The winning amount will be credited to the user's online wallet, which is accessible through the application, from which the user can transfer funds to their bank account, subject to KYC verification.
3.2 Payment to users will be made online via a third-party Payment Gateway: Razorpay (on this site, users can use credit/debit cards, NetBanking, and UPI) only after they have completed the KYC and verified their bank accounts and PAN card details. Only after the verification process has been completed will the Company instruct a third party to transfer the payment.
3.3 The payment will be credited within 72 business hours if there are no exceptional circumstances beyond our company's control that prevent us from making payment, such as a network outage, server maintenance, an issue with a third-party payment gateway, and so on.
3.4 The company is not obligated to pay late payment fee charges; however, in exceptional circumstances, payments may be delayed, or reduced after deducting applicable charges and taxes, if a reasonable amount of data supports this. The company may withhold payment even after the due date if it is not completely satisfied that the information provided by the user is correct and authentic.
4. REFUND:
4.1 Users who have entered the contest will not be eligible for a refund in the following circumstances:
4.1.1 The user has not entered any contests.
4.1.2 The user enters the contest with wallet money but does not participate.
4.1.3 The user has registered but is unable to participate due to an operator network issue.
4.1.4 Internet connectivity is terminated by the user or the data pack is depleted.
4.1.5 The user does not enter the contest within the time frame specified by the quiz's rules.
4.1.6 The user logged out midway through the game without completing it.
4.1.7 The user's device shuts down or the Phone's OS crashes after registering for the quiz and user is not able to participate.
4.2 Users are eligible for a refund in the following cases:
4.2.1 The user has registered for the game, but it does not begin due to a lack of participants.
4.2.2 The game is terminated from our end before it begins due to a technical error or other unforeseen circumstances.
4.2.3 If the app crashes during the quiz or due to a server failure, the users will receive a refund once it has been verified by us.
4.2.4 In all of the preceding cases, the refund amount will be the same as the amount used to participate in the game; no additional monetary remedies will be provided by the company.
5. CONDUCT:
5.1 The User agrees not to do the following:
5.1.1 Engage in any conduct that violates national laws, including, but not limited to, its password, login credentials, editing history, or other similar account details, confidential information gathered from other Users.
5.1..2 Publicise or conduct business in a way that is wrongful, unfriendly, dark, defamatory, divine, hateful, or promotes illegal activities such as gambling, pornography, money laundering, or any other act, material, or images that are prohibited by national law.
5.1.3 Engage in any behaviour that results in the transmission of unsolicited emails, messages, phone calls, or even posts to other Users, the Company, the Platform, and any other individuals associated with it, such as representatives, agents, or employees.
5.1.4 Market, advertise, instruct, and/or solicit activities, items, products, goods, or works derived from the same.
5.1.5 Use and file information solely for deceptive or false purposes, which is illegal.
6. RESTRICTED TERRITORY:
6.1 In compliance with the laws in effect in some Indian states, the Company may prohibit residents of those states from taking part in the Game (s). The paid versions of the Game(s) are now unavailable to users living in Andhra Pradesh, Arunachal Pradesh, Assam, Meghalaya, Nagaland, Odisha, Telangana, Sikkim, and other Indian states due to state regulations prohibiting participation in skill-based games where users must pay to enter. Therefore, users who reside in such states will not be able to access the Platform.
6.2 You accept and agree that we may monitor your online activity using various technologies, including recording your IP address in order to determine and confirm your location.
6.3 Users who live in the aforementioned Indian states or outside of India are not permitted to play for real money or make deposits to play games on the Platform. Users acknowledge and agree that if a person residing in such an Indian state registers as a User by providing false information, it is solely their responsibility. The Company reserves the right to delete or remove such an Account without prior notice, and such a User shall not be entitled to demand or redeem the Account balance.
6.4 You acknowledge and agree that Company shall not be accountable or responsible for any User's violation of any applicable state laws. Such Users may be subject to relevant fines from their respective State Governments or the Central Government of India, depending on the situation.
6.5 Users from all Indian states must always make sure they are abiding by the relevant state laws, and we will try to post any changes we see necessary to better inform the Users. You agree and accept that the User will get no consideration of any kind and that our decision in this matter will be binding and final.
6.6 The platform is currently only intended for users who live in India. If users from other countries utilize it, we are not responsible for any financial or legal repercussions.
7. INTELLECTUAL PROPERTY:
7.1 The Platform owns all trademarks, copyrights, licenses, patents, and other intellectual property. The User shall not, under any circumstances, use the intellectual property of the Platform for personal gain without the Platform's prior written consent.
8. LIMITED LIABILITY:
8.1 The User agrees that the Platform will not be held liable for any problems, including loss of access to, caused by, or related to the Platform's accessibility.
8.2 Neither the Platform nor the Company, nor any other person, representatives, or agents associated with, or even employees involved in, the Platform, shall be held liable for any direct, indirect, punitive, special, consequential, or other types of harm arising from or relating to the accessibility of the Platform.
9. GOVERNING LAW:
9.1 This Agreement shall be governed under the Laws of India and shall be subject to the jurisdiction of the courts of Allahabad.
10. DISPUTE RESOLUTION:
10.1 The client will raise tickets via email and send their questions/complaints to the support helpdesk at help@10quest.in, and the queries will be resolved within two business days.
10.2 If the issue is still unresolved, the Parties will make every effort to resolve the Dispute as soon as possible through mediation.
10.3 If all other processes fail, the parties must resort to arbitration for effective and binding dispute resolution. After mediation fails, the Arbitrators must be chosen jointly within two months.
10.4 The arbitration proceedings must be conducted in English.
10.5 The proceedings relating to the provisions of this clause will be held in the court of Allahabad, India.
10.6 Unless otherwise specified in the award, both parties are to bear equally the costs of the arbitration, including the fees of the arbitrators.
10.7 The Awards and Proceedings must be carried out in accordance with the Act's provisions. The Award issued jointly by the Arbitrators is to be considered final.
11. UPDATES:
11.1 In case there are any updates to the terms and conditions, the Users will be notified through the app and their consent will be recorded.
